<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">technology, the sponsor of the legislation emphasized the need for it but acknowledged revisions could be<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">coming based on complaints.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">Recent media reports have featured complaints about problems with the requirements of SB29 (S.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">Huffman), including how it hampers the use of technology and the fact that it requires frequently<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">disclosures to parents of how technology is used in certain cases.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">Gov. Mike DeWine signed the bill into law in July. It establishes that educational records created by a<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">technology provider contracting with a school district belong to the school and generally prohibits<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">commercial use of those records, among other features.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">The law went into effect last week. Sen. Stephen Huffman (R-Tipp City), who sponsored it, issued a<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">statement marking the occasion.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">"This law is needed now more than ever as our students face more threats from a global online presence.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">Technology is part of our lives, and in many ways, more prevalent in our children's lives.I have grown<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">increasingly convinced that we must ensure student actions online are appropriately protected.Tech<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">companies should not be able to use their access to school devices to capture our kids' data, target them,<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">or sell their data to third parties. SB29 makes several changes that boost student privacy laws in Ohio.<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">There is more work to do, as the threats are always evolving.One item in this law that does need to be<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">revised is the process of providing family notice when schools or tech companies interact with a student's<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">school-issued device.I am aware of the issue and working with educators and my fellow members of the<o:p></o:p></span></p>
<p class="MsoNormal" style="text-autospace:none"><span style="font-size:10.0pt;font-family:"Helvetica",sans-serif;color:black">legislatureto address this matter over the next few weeks while continuing to ensure that our children's<o:p></o:p></span></p>

<p class="MsoNormal">I wanted to share some additional materials associated with SB 29 compliance.
<u>Below is a link to a recording of the BASA/MCOECN webinar on SB 29 from October 17<sup>th</sup></u>. There is some great information and discussion included in this recording. Please note that there is a password needed to access the video.<o:p></o:p></p>
<p class="MsoNormal">Attached is a generic contract addendum designed to serve as a privacy agreement that can be attached to any technology provider agreement. This is provided in fillable PDF format. This blanket agreement was developed by Scott Scriven
LLP and should serve as a handy tool for SB 29 compliance.<o:p></o:p></p>
<p class="MsoNormal">Also attached is an <u>update</u> to the Securly SB 29 guidance that was initially distributed 10/7/24. This pertains to the content filtering that all (or most) of you are using.<o:p></o:p></p>
<p class="MsoNormal">Finally, I’m resending materials that were previously sent due to many additional requests for notice templates and other information that may have been overlooked by some recipients.<o:p></o:p></p>
