Good morning,
There is so MUCH confusion on Home Instruction for students with Disabilities and Students without Disabilities that I put another ticket up to DEW on it,
Here is the answer I received and it is very specific on how things are reported.
Sorry for the delay in closing this ticket with a summary of what we discussed previously.
A 504 student is not Special Ed and is not considered Special Ed for home instruction. Only Special Ed students with home instruction written into their IEP can be counted full-time with only 5 or more hours of one-on-one instruction from an appropriate licensed teacher/intervention specialist.
If a 504 student or general ed student is put on home instruction they absolutely need to have home instruction for the equivalent number of hours that they would have if they were attending full-time at the district, and the instruction can be from a teacher or tutor. For anything less than the full-time equivalent hours the student would've had if attending the district, the student could be reported as medically excused per district superintendent or the superintendent's designee decision based on the documentation provided by the parent/doctor that meets the acceptable reasons in law and complies with the district's board approved attendance policies. If the absences will be a long-term thing, then the district can choose whether they reduce the student's percent of time to only those hours that the student is receiving instruction or whether the district reports the student as full-time and must report absences for the hours the student is not receiving one-on-one instruction from a tutor or teacher. Even when reported a reduced percent of time, if the student doesn't meet the required amount of time, then the district would need to report absences for the hours of scheduled instruction that were missed.
If a student is Special Ed, then it's my understanding that a student homebound for greater than 10 days requires a status change in their IEP in order to be in compliance. Any Special Ed student on home instruction should have the details of how many hours of one-on-one instruction from a licensed Special Ed teacher/Intervention Specialist per day/week he or she will receive written in the IEP, otherwise I'm not sure how the district can accurately report attendance. The student can be reported as full-time as long as he or she receives a minimum of 5 hours of instruction per week, but that doesn't necessarily mean that every Special Ed student on home instruction receives only 5 hours per week. It's an IEP team decision that should be documented in the IEP regarding the appropriate number of hours of instruction for each individual student based on that specific student's situation. If a Special Ed student is receiving one hour of instruction each day for a total of 5 hours per week, and that student missed instruction one or two days that week, he or she is reported absent for the day he or she was not instructed. I'm not sure of what documentation an IEP team needs to determine the length of the student's instruction time that can be tolerated and whether that requires further documentation from a doctor or not. For that the district will need to check with the Office for Exceptional Children.
