I have been asked to forward the message below regarding dock days as
clarification on information that was provided to everyone earlier.

Thank you for forwarding the below email to my attention.  I am not sure
which OASBO presentation the individual below attended (since my name was
on all of the agendas at the various seminars), but I only presented at one
of the seminars and did not convey the message below regarding “dock
days.”  In fact, I did not discuss reprimanding employees during any
portion of my presentation.



What I did discuss, however, is that there is no basis in Ohio law (i.e.,
in the Ohio Revised Code) for “dock days.”  As such, any authority for
“dock days” should come from a collective bargaining agreement between the
Board of Education and the particular employee requesting a “dock day.”  If
there is no such provision in a collective bargaining agreement, an
employee is not entitled to unilaterally take a “dock day.”



“Dock days” are, of course, different from an unpaid leave under R.C.
3319.13.  One of my colleagues (Derek L. Towster) did discuss the issue of
reprimands at the seminars he attended and simply stated that if an
employee takes an unapproved “dock day,” the employee is absent without
leave and could be subject to disciplinary action for such an absence.
