4432.01 - SICK LEAVE POOL

The Board of Education agrees to create a sick leave pool for the benefit
of any employee not represented by a union group in the school district.

The pool will be established on a voluntary basis with any contributing
member donating a minimum of five (5) sick leave days. Employees who donate
to the sick leave pool will have the number of donated sick leave days
deducted from their accumulated sick leave. Employees contributing to the
pool will be deemed to have used the sick days contributed at the time the
contribution is made.

The sick leave pool may only be used for catastrophic injury of the
employee or life-threatening illness of the employee (as determined by the
administration) that causes an extended absence from work.

Employees will inform the Superintendent of their need for additional sick
leave days. The Superintendent and the applicant will then be responsible
for notifying the employees not represented by a union group of the
opportunity to donate sick leave days.

Employees wishing to contribute to the pool may do so by notifying the
Superintendent in writing of the number of days they wish to contribute.

When employees exhaust their sick leave days, they may apply for the number
of days needed to resolve their medical problems. The maximum number of
days an employee will be allowed to apply for is the remainder of the
fiscal year (June 30).

Any unused portion of the pool shall remain in existence for the following
year in case of relapse or complications; thereafter the days will revert
to the Board.

The employee must have four (4) years of service in the Swanton Local
School District to be eligible to use the sick leave pool.

An employee must make application for STRS or SERS disability during the
first thirty (30) days of use of the sick leave pool. The employee must
provide verification of the application to the Treasurer. If an employee
fails or refuses to make application for STRS or SERS disability within
thirty (30) days from the date of first draw, they will lose the privilege
of using the sick leave pool beyond the initial thirty (30) days. The
employee may continue to use the sick leave pool until the STRS or SERS
disability decision is rendered. If application for STRS or SERS disability
is denied, the employee may continue to use the sick leave pool. The time
restriction and the requirements may be waived by the Board.

If an employee is accepted to draw disability under the STRS or SERS, the
employee will not be eligible to continue to use the sick leave pool.
